Ex-finance boss brings suit vs. town

WEST NEWBURY — Tracy Blais, the town's former finance director who was ousted earlier this year by selectmen, has filed a discrimination complaint against the town and three town officials.

In a 22-page document made available to the press yesterday by Barbara Green of the Massachusetts Commission Against Discrimination, Blais asserts that she was discriminated against in retaliation for a sexual harassment charge she brought against former Selectman John McGrath in 2007. The complaint, filed on June 20, lists McGrath, along with the Town of West Newbury, Selectman Tom Atwood and former Selectman Glenn Kemper as the employers who discriminated against her.

Green said the complaint has been formally served on the respondents, who now each must issue a written position statement, which will be forwarded to Blais for rebuttal.

"Once those have all been submitted, the investigators begin their work," Green said.

No monetary damages were included in the complaint, but Green said any awards would be assigned at the conclusion of a public hearing, which would only occur if MCAD issues a Probable Cause disposition. The parties also have the option of going to early mediation or settling prior to the issuance of a disposition.

"It is the position of the town that the claims are without merit and the town expects to vigorously oppose this action," said town counsel Michael McCarron, noting that selectmen have not officially been served with the complaint, but a copy was provided by Blais' attorney.

Blais confirmed yesterday that she and her lawyer met with selectmen in a closed-door session Monday night to discuss a possible resolution to the charges.

"Beyond that, I have no further comment at this time," she said.

The town's finance boss for 19 years, Blais was not rehired this spring in a controversial vote that pitted Atwood and Kemper against Selectman Dick Cushing. Selectmen declined to speak publicly on the specific reasons for their vote at the time, but instead released 400 pages of executive session documents in which Atwood and Kemper voiced serious concerns about an annual $2,500 merit bonus they say Blais took for 14 years without authorization and a few payroll discrepancies in which she was overpaid. Blais reimbursed the town $6,972.76 for the payroll mistakes but insisted she was entitled to the merit bonuses. Selectmen have never asked her to repay the $35,000 they claim she took outside her contract.
